Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the Bendy BethC Content Agent (“the App”), hosted at agent.bendybethc.com, and any related public-facing pages and APIs. By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you may not use the App.

2. What the App Is

The App is a content management and analytics dashboard operated by the Bendy BethC brand — a chronic illness advocacy and education creator business. It is used to:

  • Plan the Brand’s social media content calendar
  • Draft captions and posts for Brand-staff review
  • Analyze how content posted to the Brand’s own TikTok, Instagram, and Facebook accounts is performing
  • Display the Brand’s own published TikTok posts publicly on this website via the /tiktok showcase

The authenticated dashboard is restricted to the authorized creator account owner and is not open for public sign-up. Public pages (this one, the Privacy Policy, the Data Deletion page, the landing page, and the TikTok showcase) are accessible to everyone, including platform reviewers and the general public.

3. Public Audience vs. Authorized Users

Public visitors may view the landing page, the TikTok showcase, and these legal pages. Nothing in these Terms grants public visitors any right to access the authenticated dashboard.

The authorized creator account owner is responsible for keeping dashboard credentials secure, not sharing access with unauthorized people, and using the App only for legitimate Bendy BethC creator account operations.

4. Use of Third-Party Platforms

The App interacts with third-party platforms through their official APIs, including:

  • TikTok for Developers API — subject to the TikTok for Developers Terms of Service
  • Meta Graph API — subject to Meta’s Developer Platform Terms
  • OpenAI / Anthropic APIs — subject to their respective terms

The App only accesses data from accounts owned and operated by the Brand. It does not scrape, collect, or process data from any account that has not explicitly authorized it.

5. Content and Intellectual Property

5.1 Brand content

All content published by the Brand on TikTok, Instagram, Facebook, and this website — including videos, captions, cover images, and written posts — is the intellectual property of Bendy BethC unless otherwise credited.

You may share links to the Brand’s public social posts and embed them in accordance with the source platform’s terms. You may not republish, resell, or train AI models on Brand content without written permission.

5.2 The App itself

The App’s source code, design system, and branding are the property of Bendy BethC. The App is provided “as-is” with no commitment of availability or uptime.

6. Medical Disclaimer

Content published by the Brand — on this website, on TikTok, on Instagram, or anywhere else — is for educational and community support purposes only. It is not medical advice. It is not a substitute for consultation with a qualified healthcare provider.

Always seek advice from your own doctor or other qualified health professional with any questions about a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read or watched from the Brand. If you think you may have a medical emergency, call emergency services immediately.

7. Acceptable Use

You agree not to use the App or the public website to:

  • Violate any applicable law or regulation
  • Infringe the rights of others
  • Attempt to gain unauthorized access to any non-public portion of the App
  • Scrape, copy, or republish content at scale without permission
  • Disrupt, overload, or attack the App or its infrastructure
  • Use the App or its APIs for any purpose other than the Brand’s legitimate content operations

8. Disclaimers

The App and the website are provided on an “as-is” and “as-available” basis. Bendy BethC makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or entirely secure. Third-party platforms (TikTok, Meta, OpenAI, Vercel) may change, rate-limit, or suspend their services at any time, which may affect the App.

9. Limitation of Liability

To the maximum extent permitted by law, Bendy BethC and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses resulting from your use of, or inability to use, the App or the website.

10. Indemnification

You agree to indemnify and hold harmless Bendy BethC and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the App, or your violation of the rights of any third party.

11. Changes to These Terms

We may revise these Terms at any time. Material changes will be reflected in the “Last updated” date at the top of this page and, for changes affecting platform API usage, noted in the relevant Developer Platform app listing. Your continued use of the App after an update means you accept the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of law principles. Any disputes shall be resolved in the courts located in North Carolina.
